This policy is intended to help you understand how ElementR and affiliates collect, use and safeguard the information you provide on our website. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

ElementR collects and stores any information you enter on our website or provide us in any other way. Below are some examples:

  • ​Identity Data includes first name, last name, date of birth and gender

  • Contact Data includes address, email address and telephone numbers

Anonymous data, where you cannot find out who the data relates to, is not personal data.

We will occasionally conduct on-line surveys to better understand the needs and profile of our visitors. When you place an order for a product, we need to know your name, e-mail address, mailing address, credit card number and expiration date. This personal data is required so that we can process and fulfill your order, send an order or shipping confirmation, as well as notify you of your order status.

All internet transactions with ElementR are performed on a secure server that encrypts your credit card information to ensure it is not read by unauthorized third parties.

We may collect anonymized details about your use of the website for the purposes of aggregate statistics or reporting purposes. Aggregated data (your data combined with other people’s data) may come from your personal data but if it does not directly or indirectly reveal your identity, it is not considered personal data. We use a third-party payment processor, currently Wix, Stripe or PayPal (“Payment Processors”) to assist in securely processing your Payment Data. The Payment Data that you provide through the services is encrypted and transmitted directly through the respective Payment Processors servers. We do not control and are not responsible for the Payment Processors or their collection or use of your information. 4. How we store your personal data

ElementR is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

5. How we communicate with you

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce applicable laws and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages and postal mail.

These companies may then contact you directly with product or sample offers, personalized offers and information, or to ask for your feedback on products and programs that they think may be of interest to you.

 

While we use all reasonable efforts to safeguard the confidentiality of your information, in relation to third parties, ElementR will have no liability for disclosure of any information obtained due to errors in transmission or their unauthorized acts. ElementR also reserves the right to change or update this policy, or any other policy or practice, at any time, with reasonable notice to users of its website. 

 

Any changes or updates will be effective immediately upon posting to the ElementR site. We may share statistical or aggregated non-personal data about our users with advertisers, business partners, sponsors and other third parties. This data is used to customize ElementR website content and advertising to deliver a better experience to our users.

We use cookies, pixel tabs (also known as web beacons, flash cookies and clear GIFs) and similar technology (“Data Collection Technology”) to automatically collect information (including Other Information) about you when you use the website. ElementR generally does not treat Other Information as personal data unless required by applicable law. Data Collection Technology collects all sorts of information, such as how long you spend on various webpages in the website, which webpages you view, your search queries, error and performance reports, as well as device identifier or IP address, browser type, time zone and language settings and operating system. 

 

Data Collection Technology deployed through the website includes cookies and web beacons.

Web Beacons: A web beacon (also called a pixel tag or clear GIF) is computer code that communicates information from your device to a server. Some of ElementR’s content and emails may contain embedded web beacons that allow a server to read certain types of information from your device, allow us to count the number of people who have viewed content, to know when you opened an email message and the IP address of your device.  Web beacons help ElementR’s develop statistical information to provide better and more personalized content.

How ElementR Uses Data Collection Technology: Some Data Collection Technology is deployed by ElementR when you visit the website. Other Data Collection Technology is deployed by third parties with which ElementR partners to deliver the website.

Data Collection Technology helps us improve your experience of the website by, measuring the success of marketing campaigns, compiling statistics about use of the website and helping us analyze technical and navigational information about the website.

 

We also may use Data Collection Technology to collect information from the device that you use to access the website, such as your operating system type, browser type, domain and other system settings, as well as the language your system uses and the country and time zone in which your computer or device is located.

9. Policies for children

ElementR encourages parents and guardians to monitor and participate in their children’s online activities. No information should be submitted to this site by users under 18 years of age, and users under 18 years old are not allowed to register for newsletters, clubs or activities. In addition, users under 18 years of age are not allowed to make purchases or participate in contests. Where appropriate, ElementR may ask you to indicate your age to verify compliance with these policies.

Right to Access Specific Information and Data Portability Right

 

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. 

 

You may only make such a request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination
